Mandating self-archiving is no more an "admission of defeat" than
mandating publishing itself ("publish of perish"). It is just part of
the usual carrot and stick incentive system with which researcher
productivity is rewarded and sustained.

Flawed arguments, whether for OA or anything else, and whether used
by friend or foe, should be exposed for what they are rather than
being used or relied upon.
